TERMS & CONDITIONS

1. PRODUCTION TIME:   We strive for a 7 to 10 business day turn-around on all orders, but actual production time depends on the capacity of our factory at the time your order is placed.   If you have a time-sensitive event or in-hands need date for your decorated items, please advise our sales department WHEN THE ORDER IS PLACED.   Rush orders are available for an extra charge -- please call the factory for information on additional charges for this special service.

2. PRICING:   All pricing is FOB our Minnesota factory.   Prices are subject to change without notice.   We reserve the right to correct any pricing that shows erroneously on our web site and promotional materials.

3. ORDER ACCEPTANCE:   All orders, terms and conditions of sale are binding upon the buyer after order acceptance by Outside Connections, LLC d/b/a WearablesNow.com.

4. CANCELLATIONS:   If an order must be cancelled, WearablesNow.com must receive written notice before production has started.   If blank garments have shipped from one of our regional warehouses, the customer may incur restocking and shipping charges as a result of the order.   Orders for goods that have already been decorated may not be canceled by the customer.

5. RETURNS:   Returns are accepted only on unaltered garments.   No returns accepted after 30 days from delivery.   All returns are subject to a 20% re-stocking charge, with the exception of product samples.   Returns are accepted ONLY with a return authorization number.   The R.A. must appear on the outside of the box near the return label to ensure credit is properly given to the items.

6. OVERRUNS/UNDERRUNS:   All orders are subject to a 5% overrun or underrun and will be shipped and billed accordingly.   This is done as per trade custom.

7. PRODUCTION ERRORS:   From time to time an error in the production of a buyer’s imprint or order will occur.    If the error is determined to be as a result of actions by the buyer, we will work with the buyer to correct the error and, when possible, discount merchandise on the subsequent corrected order.   If, on the other hand, the order error is determined to be that of WearablesNow.com, we will authorize the return of the original decorated product at our expense and correct the error with a subsequent product shipment at no additional expense to the buyer.   WearablesNow.com is not responsible for any errors when the buyer submits a digitized file.

8. PROOFING:   We proof all new orders prior to decorating.   It is your responsibility to carefully check over the proof and provide us with written authorization as to how we should proceed with the order.   The production time clock for the order stops while the proof is in the customer's hands.   Please review the proof quickly and provide your comments.   Any order with a signed proof approval that is later deemed to be problematic with the buyer is the buyer's sole responsibility.

9. BACKORDERS:   We will notify you if any item your order is out of stock.   Out of stock items will be automatically backordered unless the buyer instructs us to do otherwise.

10. TERMS & PAYMENT:   Buyer must pay by cash, credit card or check in advance, including estimated freight, unless prior credit arrangements have been made.   Credit terms are balance due at the time of invoice receipt.   All invoices are mailed to the buyer at the time of order shipment.    A service charge of 1-1/2% per month (18%APR) will be charge on all accounts over 30 days past due.   Accounts that are grossly delinquent are susceptible to credit collections activity and will be governed by the terms and conditions found on that signed application.

11. C.O.D.'s:   Not available.

12. FUNDS:   All pricing shown on this web site is in U.S. funds.   Certain products may not be available for shipment outside of the U.S.

13. FREIGHT CHARGES:   Standard freight charges for most orders include United Parcel Service ground service to the continental United States.   Buyers who live outside the continental U.S. must call for a shipping quote.   Buyers who wish to supply their own shipping account number may do so, but must call the factory for details.   Buyers who request expedited shipping via Federal Express or UPS may choose to do so at actual freight rates specific for those services.

14. Freight Claims:   Claims for freight adjustments, breakage or delays in transit must be filed with the carrier within 15 days.   For UPS shipments, buyers must contact their local UPS office at place of delivery for damage inspection prior to notifying WearablesNow.com.   WearablesNow.com will assist as necessary in the buyer's processing of any claims with the freight carrier.

15. COLORS, SIZING & PACKAGING:   Slight variations in dye lots may occur.   Be sure to follow all care labels on the garments.   Due to the nature of photography on the web, product colors as depicted may not be true to life.   We therefore recommend that a sample of any product be ordered to ensure the accuracy of the color shade and sizing being contemplated on your garments.

16. REQUIRED ARTWORK:   Camera-ready art is required for all buyer-supplied logos.    WearablesNow.com prefers one-color black on white logos that will be scanned into our computers.   Artwork generated from laser printers should be submitted at 300% actual use size.   If electronic media is to be used, please call (507-789-5189) for information.   Artwork from a copy machine, a fax machine or embossed materials IS NOT ALWAYS SUITABLE.   All multi-color artwork designs must be color separated with the color breaks clearly indicated.   If artwork is to be returned please indicate those instructions on the order.   Re-work of artwork, including color separations for multi-colored work will be billed at the rate of $30/half hour.   WearablesNow.com will contact the buyer and provide an estimate on the total cost of the art needed for completion of the project being ordered.

17. DECORATION SIZE AND LOCATION:   Your order must clearly indicate what sizes you want your decoration to appear and at what location on the garment.

18. Copyright Notice:   All materials appearing anywhere on WearablesNow.com's web site are protected by worldwide copyright laws and treaty provisions.   The copyright is held by Outside Connections, LLC or by the original creator of the materials.    No materials from this web site may be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any form or by any means other than as described by WearablesNow.com or with Outside Connections, LLC's prior written permission.   All rights not expressly granted herein are reserved.     Any unauthorized use of the materials appearing on the WearablesNow.com web site may violate copyright, service mark, trademark and other applicable laws and could result in criminal or civil penalties.

19. Trademarks and Service Marks:   All trademarks and service marks are property of their respective owners.   WearablesNow.com is a duly registered trademark and service mark in the State of Minnesota by Outside Connections, LLC.   Outside Connections, LLC recognizes and will aggressively protect all Common Law intellectual property rights in any jurisdiction throughout North America.

20. Sales Tax:   WearablesNow.com is located in the state of Minnesota and is currently obligated to withhold 6.875% sales tax for certain purchases and/or services within that state. Minnesota organizations holding a tax exemption certificate must provide a copy of that certificate prior to ordering or sales tax must be charged and subsequently paid. Because of the ever-changing tax collection situation on Internet transactions, there may be additional sales tax jurisdictions in which we may be required to collect on for the future. Buyers curious if their order will be subject to sales tax, or other forms of taxation, should contact our office prior to making any purchase for additional clarification on this matter. Please understand, however, that your purchase my be subject to your local tax jurisdiction’s use tax requirements unless it is specifically exempt from taxation. Therefore, any purchase made from WearablesNow, whether directly taxed or not at time of sale, may ultimately be subject to taxation and this reporting and payment obligation, under most circumstances, falls to the purchaser of the goods and/or services.
